Our Building Surveyors are often called upon to act as Expert Witness when a dispute arises about boundaries or a building. Acting as an expert witness requires a significant amount of specialist knowledge and experience in the subject in dispute, as well as the ability to attend court and take questions from the other party’s legal team.
We were instructed by the client’s solicitors to advise on a boundary dispute following the sale of land and splitting of a Title.
We inspected the client’s property and adjoining property to assess the location of the site features in relation to the TP1 land transfer form and Title documents. We undertook full measurement of the site and analysed the data in relation to the available mapping and client data. Following our assessment of the situation we produced a CPR (Civil Procedure Rules) Part 35 compliant report to advise on the likely location of the registered boundary.
The client accepted our advice and the boundary was agreed upon.
